The following sections of your Terms and Conditions for Current Accounts, Open24, Savings and Investments have been amended or replaced and are effective from start of business 17th October 2013.
New wording in conditions: We reserve the right to require verification of identity and address from you where your Account is designated as an “Inactive” Account, that is to say where no transactions have been effected on the Account for a continuous period of 3 years and for the purposes of this condition, a transaction is a lodgement or transfer to or a withdrawal or transfer from the Account.
New wording in conditions: You shall immediately notify us via our Open24 Service by telephone at 1800 687 687 (or, if calling from outside Ireland, at +353 01 212 4290 if:
(i) any Card, Device, PIN, VbV password or other Security Feature is mislaid, lost, stolen or copied or otherwise becomes liable to misuse;
(ii) you cease to own, control or use any Device or the number of the Device changes;
(iii) you change address;
(iv) you know or think it is possible that any Security Feature has become known to any other person;
(v) unauthorised or irregular transactions are recorded on an Account.
Such notification must be confirmed by you in writing within 10 days to the Branch at which the Account is maintained. You shall take all measures necessary to make yourself aware of the circumstances above.
New wording in conditions: You will be liable for the full amount of unauthorised payments where:
a) you intentionally, fraudulently, or with gross negligence fail to adhere to the safe keeping requirements and/or non-disclosure obligations in respect of your Card, PIN, VbV Password or other Security Feature; or
b) any Card is used by any person outside the terms of this Agreement and who has possession of it with your consent, or
c) you have intentionally, or because of your lack of reasonable care, failed to notify us of the loss, theft or misappropriation of the Card or any Security Feature without undue delay.
New wording in conditions: You will be liable for the full amount of unauthorised payments where:
(a) You must exercise all reasonable care to ensure the safety of the Card and prevent the PIN and VbV Password or other Security Feature becoming known to any other person. We consider lack of reasonable care to be but not limited to circumstances where:
(i) the Card is lost or stolen and the PIN, VbV Password or other Security Feature became known or available to a third party who then has access to the Card (e.g. a finder or thief) or
(ii) someone possesses the Card with your consent and uses it or gives it to someone else or
(iii) your PIN, VbV Password or any other Security Feature is easily obtained or guessed by someone else.
(b) In addition to taking the necessary steps to safeguard your Card, PIN and/or VbV Password as set out in this Condition 5(e) you must keep your Card secure at all times and you must not:
(i) let anybody use your Card, PIN or VbV Password.
(ii) reveal your Card number to anyone except when completing a transaction or when reporting the Card lost or stolen or where it is likely to be misused; or
(iii) disclose, record or write your PIN or VbV Password or other code allocated to you or record the PIN or VbV Password on the Card or on any item which you usually keep or carry with the Card or in any form that would be intelligible or otherwise accessible to someone else.
If you do not wish to accept the updated terms and conditions, you may terminate your agreement with us in line with your existing terms and conditions. If you do this, you must repay any money or charges due, but there will be no additional cost. If you do not contact us to terminate your contract, you are deemed to have accepted the changes from start of business 17th October 2013.
